ACCEPTABLE USE OF THE SITE

This provided information will be used to create an individual ChopUp user account for you.

You understand and accept that you are exclusively responsible for maintaining the security of your log in details including your username and password. You will be held liable and responsible for any unauthorized use of your account or password.

You will maintain only current, accurate, truthful and complete information in your ChopUp account, and your failure to do so may result in your inability to access and use our services. We may also terminate this agreement with you.

You are allowed to have and operate only one ChopUp account, except otherwise permitted by us in writing.

All of the content and materials provided through, contained in or shown on the ChopUp website counting but not restricted to text, communications, graphics, information, code, illustrations, photographs, sounds, video, moving images, and all other materials (altogether known as Òcontent") is owned by ChopUp, its associates, content providers or licensors. All such content is fully protected by, trademark, copyright and all other relevant Nigerian laws and international treaty provisions. You are not to use any of the content in any way except as permitted by this agreement or with the prior written consent of ChopUp. Any unauthorized use of our intellectual property and copyright by you may lead to criminal or civil penalties being brought against you.

All trademarks, trade names, trade dress, logos, service marks, icons and domain names made available on this website are the property of ChopUp, its affiliates, respective licensors or other third parties. You may not use, republish, distribute, reproduce, transmit, copy, or change the trademarks made available through this website in any way without ChopUpÕs prior clear written consent. 

Some other trademarks, logos, and service marks provided on the ChopUp website are the service marks, logos or trademarks of a third party and may not be used, reproduced or copied without the permission of the owner.

 

USER CONTENT AND UPLOADS

The ChopUp website contains interactive services such as blog, news, discussions, comments and others. In your use of them, you are not to publish, post, upload, broadcast or distribute any unsuitable, profane, derogatory, defamatory, improper, infringing, indecent, lewd or illegal topic, material, name, or information. You may not upload files containing corrupted folders, viruses, or any other technologically harmful software or programs.

We reserve the right but not the obligation to edit, screen, monitor or revise user content. We may suspend your use of the ChopUp website at any time and for any reason, especially if we in good faith believe that your user content is in clear breach of this agreement.

You are not to use the ChopUp website to spread content that instigates or motivates criminal offenses, or otherwise breaches any relevant laws or regulations; and you may not upload advertisements, spam links to other individuals or websites or solicitations, without prior written permission from ChopUp.

Do not under any circumstances upload content that purports to be any other person or entity, including without limitation, an ChopUp official, or falsely state or misrepresent your relationship with a person or entity.

You are not to use the ChopUp website in a way and manner that Interferes with other usersÕ use of the website; and you must not advertise chain letters or pyramid schemes on the website; and/or misuse any part of the ChopUp website for illegal purposes including without limitation spreading any slanderous, illegitimate, offensive, harassing, harmful, hostile, or otherwise obnoxious material.

You may not under any circumstances collect other usersÕ content or their information utilizing automated means like harvesting bots without our prior permission; or use or attempt to use any device, procedure, or software to interfere with the proper working of the website, or violate or attempt to violate the security of the ChopUp website.

Do not upload, post, transmit or provide any content that you do not have a right to make available; forge headers or otherwise manipulate identifiers in a bid to disguise the origin of any content transmitted through the website; and/or post content or material that oppresses, degrades, aggravates, or intimidates a person/group of individuals because of religion, sexual orientation, age, race, ethnicity, gender, or disability.

If you are found to breach any or all of the provisions of these terms, you will be held solely responsible for all and any legal costs and losses arising out of your breach. We may terminate your use of the website without any prior warning if you breach any of these terms.

 

PARTICIPATION IN CHOPUPÕS GAME TOURNAMENTS

To participate in our online game tournaments, you must either be a Nigerian citizen or be resident in any of the 36 states of Nigeria or its Federal Capital Territory.

You may not allow any other individual to use your ChopUp account to participate in any of our competitions. Your account must be used by you alone. You may under no circumstances use automated means or computer software to play.

You accept and admit that our currency of operation is the Naira. All payments to and withdrawals from your account shall be in Naira.

You accept that all payments to and withdrawals from usersÕ accounts shall be made through Paga accounts. You can only pay to participate in a tournament through a Paga account and will also receive winnings through the same Paga account.

Winners are paid exclusively through their Paga wallets and will receive payments within 48 hours of completing the tournament. You however understand and accept that this payment timescale is indicative only, and we will not be held liable for our failure to pay you within 48 hours of completing your tournament for reasons outside of our control.

 

FAIR PLAY POLICY

ChopUp encourages its users to be thoughtful and show good sportsmanship in their use of our website and services. You must not:

á      Engage in abusive behaviour such as using hate speech, racism and other discriminatory language and/or engaging in obscene or sexually explicit banter

á      Resort to threats or harassment

á      Engage in excessive swearing

á      Engage in bullying

á      Cheat

á      Illegally use third party software

á      Buy, sell or share game accounts

á      Ask for or provide personal contact information and/or

á      Misuse in-game chat for scamming, spamming and advertising

FOR THE JURISDICTIONS THAT MAY NOT ALLOW THE EXCLUSION OF CERTAIN DAMAGES, SOME OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU. YOUR SOLE REMEDY AGAINST CHOPUP FOR ANY DISSATISFACTION IS TO STOP USING THE WEBSITE.

 

INDEMNITY

You hereby agree to indemnify and hold ChopUp, its affiliated companies, and their employees, officers, agents, and directors guiltless and innocent against all liabilities, costs, losses, damages, attorneysÕ fees and costs, and all other expenditures connected to any actions or claims brought against ChopUp as a result of your breach of any portion of this agreement or any other liabilities emerging out of your use of this website.

 

DISPUTES/GOVERNING LAW

Except where prohibited, you agree that every claim, dispute, and cause of action (whether directly or indirectly) resulting from your use of this website shall be resolved individually every time, and without resorting to any kind of class action.

These terms of use are construed in accordance with and interpreted according to Nigerian laws and shall be so governed. You consent to submit to the select jurisdiction of Nigerian courts.

 

SEVERABILITY

If any portion of this agreement is adjudged by a relevant court of law to be unenforceable or invalid, then the specific invalid or unenforceable provisions will be deemed succeeded by a valid, enforceable provision that most closely reflects the intention of the original provision. The remainder of the agreement shall then remain valid and continue to be in effect.

 

WAIVERS

You understand and admit that no waiver of any provision of these terms of service will be deemed a waiver of any similar provision, or a waiver of that provision at a later date. ChopUpÕs failure to enforce any term of this agreement shall not be taken as a waiver of ChopUpÕs rights hereunder at any time to enforce the strict compliance thereafter with every term hereof.

 

 

ENTIRE AGREEMENT

You agree that these terms of use, and all other materials referenced constitute the entire agreement between you and ChopUp regarding our website and services. They succeed all other communications (whether written, spoken, or electronic) between you and ChopUp concerning our services and will govern our future relationship.

 

TERMINATION

We may fully terminate or temporarily suspend your access to the ChopUp website, delete your profile as well any content or information uploaded by you on the website for any or no reason, and at any time in our exclusive discretion, without notice to you, effective immediately.

 

CHANGES

This agreement may be reviewed, modified, changed, added to, or deleted from at any time at ChopUpÕs discretion without prior notice. Using this website in any way after a change has been uploaded shall be taken as your acceptance of this agreement, as modified. We therefore advise users to check this page frequently.
